HOW DOMESTIC VIOLENCE CASES START
The usual case begins with a call from a party or third person regarding a domestic violence situation. The responding agency is the NYPD. When the police arrive on the scene the investigation is usually cursory and an arrest usually occurs. The police do not want to be accused of not doing enough in a Queens Domestic Violence case, so an arrest usually results in these case.
The defendant is then taken to central booking and processed which usually takes about 10 hours. The defendant will then see a judge to determine if bail will be set. Another adjourn date is set. If the family has a case in family court, the case is then tranfered to IDV court.
